kristen sze. i'm eric thomas. first a look at the weather forecast. check out clouds i wanted to show you what was coming in from the coast over san francisco that's all there is of these low clouds few and far between and will leave quickly nothing showing up now maybe a little drizzle. for the most part quiet with unlimited visibility with the mid and upper level clouds that will stay for the better part of the afternoon. stepping out now, 52 santa rosa, 60 antioch most of us mid to upper 50s. i put more 80s in the forecast and i've raised the temperature in some areas i'll show that you forecast in a few minutes. chp just arrived at the scene of this injury crash in san jose. north 101 alum rock possibly the left lane and even the right lane is blocked. traffic slow right at the scene. with the chp there we'll find out if they can expect to

clear some of the lanes. highway 87 possible alternate moving quickly at 62 miles an hour. i want to take you to a live shot of the bay bridge only a minor delay for some of the cash paying lanes metering lights haven't been turned on yet. another live shot of the san mateo bridge, there was a high wind advisory looks like the sign has been turned off. we continue to follow a developing story in richmond. right now police are searching for a suspect after an early morning shooting. we first brought you the story in our last hour. the shooting happened near south 7th and virginia streets overnight. frances says right now one block of south 7th street is still closed for the investigation. the victim was found inside a car, ultimately rushed to the hospital. the victim is in critical condition. no word on any suspect description. suspended san francisco sheriff ross mirkarimi goes back to court this morning to

fight for his job. meantime, he speaks in detail about the argument that led him to bruise his wife's arm. amy hollyfield is live at superior court. >> reporter: he's fighting inside and outside court. inside he's going to try two ways over the next two days to try and get his job back. first, ross mirkarimi believes he has found a way to try to get the city attorney kicked off the case. he thinks he's got a conflict of interest. he's going to ask the judge to look at that tomorrow he's going to ask the court to overturn his suspension. he's launched a campaign outside the courtroom. a public relations campaign. he appeared on radio show forum yesterday to explain his side of things. here's how he describes bruising his wife's arm, which has been the center of this case. he says they were having an argument on the way to lunch. >> i reached over from the driver's seat, still with my

seat belt on to put my hand under her arm to try to guide her back into the passenger's seat so we can escalate this and talk this through. -- we can deescalate this and talk this through it was that she got bruised. >> reporter: ross mirkarimi was suspended without pay from his job last month after being sentenced to three years probation for a guilty plea to a false imprisonment charge in connection with the fight they were having. it looks like he won't be successful in today's fight. the judge tentatively ruled yesterday the city attorney can handle this case. they will argue that today in court. if he loses today and tomorrow, then he will have a hearing before the ethics commission starting monday over whether he can remain as san francisco's sheriff. amy hollyfield, abc7 news. in oakland this morning, police are on the hunt for a suspect who shot and killed a 24-year-old man while the

victim was pushing his 1-year-old son in a toy car yesterday afternoon 3:15 in east oakland at fenham and 66th avenue not far from the coliseum. police say tyrell smith had been walking didn't the street when the suspect got out of a car and shot him before driving away a neighbor quickly scooped up his son kyrell and carried him to safety. >> if you know me you know i'm gonna get to the bottom of this we gonna find out who he is, you will be brought to justice. >> victim's mother says she hopes her grandson will be too young to remember what happened. for the first time since a deadly shooting spree three weeks ago, classes at oikos university will resume monday most classes will be held in the same building where list say former nursing student one owe, 43-years-old, kid six former classmates and a receptionist on april 2nd. several students said they will not return and only willing to complete their

degrees if classes are held at another location in the past few weeks the director of the school raised concerns about whether the university can survive long term. anyone who planned to attend the oakland city council meeting on may 1st, will have to change plans. the council now plans to meet one day earlier to avoid may-day protests from occupy oakland. occupy oakland members have interrupted past city council meetings and they plan a march and protest outside city hall may 1st. the rescheduled meeting monday april 3rd, 5:30 p.m.. public utilities commission expected to died today whether to fine pg&e three million dollars for failing to fine all safety records. -- to find all safety records. state regulators ordered pg&e to turnover all records following the deadly san bruno explosion in 2010. the company admitted it can find all the necessary

records. initially the puc threatened to fine the utility a million dollars a day until all the records were found. pg&e alerting neighbors in san mateo county about a natural gas pipeline near i-280 and highway 92. crews had have to event the pipeline so pg&e warning you may get a whiff of natural gas. if you have any questions or concerns about the smell of natural gas, call pg&e at the number on your screen: 1-800-743-5000. today the 49ers and santa clara officials will break ground on the new stadium site. construction equipment was out yesterday. the team has released this animation it will look like from the 50 yard line in the center of the field, a cool view there the new stadium is estimateed to cost 12 billion dollars and will seat more than -- 1.2 billion dollars

upper 60s san francisco and richmond low to mid 70s bay shore and north bay valleys south bay and east bay santa clara valley and east bay valleys upper 70s to near 80°. i think the next two days, friday and saturday we could have 80s everywhere except the coast. as warm as you get saturday upper 60s. slight cooling trend sunday temperatures monday, tuesday, especially into wednesday 10° cooler than over the weekend. back to san jose, this injury crash is causing slow traffic on north 101 right at alum rock. it is just a very short scene now where traffic is heavy notice the real-time speeds just went down to 13 miles an hour, causing a five minute delay. highway 87 moving at 70 miles an hour possible alternate. i want to show you the bay bridge toll, metering lights haven't been turned on yet. minor back up for some of the cash paying lanes.

let's take a look at this amazing video of a boat fire at a port in istanbul, turkey. fire tore through in minutes everybody hanging on for dear life they were rescued safely, crews say if the boat had not been sailing through a busy port those onboard might not have survived. turning to baseball. giants cain and phillies lee in a pipper's duel last night. cain allowing just two hits lee throwing 10 scoreless incredibly neither factored into the final decision in the

don't know what they will cost. 13% have been priced, still a ways to go on that there's even a possibility that those who don't want this stadium are going to step up and try one more time in court. that is not going to be discussed today. they are going to be talking about the future of this incredible franchise and they are ready to go out here. ceremonial groundbreaking 5:00 this evening. the public is invited by intention -- the public is not invited, invitation only. it should be wild and it is loud. terry mcsweeney, abc7 news. just three hours from now, suspended san francisco sheriff ross mirkarimi will return to court to continue the fight to keep his job. today mirkarimi is expected to find out if a judge will approve his motion to remove city attorney dennis herrera from the case. the judge issued a tentive ruling yesterday siding with

herrera. mirkarimi's claims a conflict of interest for herrera to represent the mayor as well as the ethics commission. herrera told the court this week that the ethnics commission will be advised by outside counsel. san francisco's malcolm plex changing hands after the current owner spent millions to spruce it up one of eight properties the westfield group will sell for more than a billion dollars. the mall in fairfield part of the deal. westfield says it will finish 30 million dollars in improvements, including the addition of a target before the sale is final. bay area mayor calling it quits. san carlos mayor andy klein has resigned from office effective immediately citing major setbacks in his personal life. he said he and his wife decided to dissolve their marriage. he said he has begun treatment to address his situation. he did not elaborate.

50 students at berkeley high put computer skills to use this morning they are paying for it. when are an -- they are accused of hacking in the school's system change attendance records. >> reporter: 50 students are being suspended, as many as four might be expelled in connection with this high-tech hacking scheme. the students have not been named. administrators say those involved were changing attendance records dating back to december they were using their home and school computers, sometimes reportedly even during class in some cases they were deleting absences and tardies from their own records or those of their friends. in other scenarios it was a money-making scheme. >> absences that were initially logged in by teachers, had been corrupted,

altered. >> i heard there were like, someone -- they were selling the passwords. >> reporter: it is not known how much money exchanged hands between students. five administrators spent months investigating the hacking and identifying the students involved. they confronted those students before spring break. the suspensions will last between one and five days. expulsion can last up to one year. as for why? you probably have a good guess students didn't want parents to know they were skipping school. athletes wanted to stay eligible to play and still skip school and teachers can drop grades for too many unexcused absences. katie marzullo, abc7 news. a lot of kids are going to school this morning and they want to know how to dress. we have the warm-up, something to consider. >> you know what you wanted to say. this would be a great day in kids were wanting to skip school, we are not recommending that.

through monday, friday and saturday we'll have 80 around the bay. the coast never gets above upper 60s summer-like pattern with the microclimates we could be 20 to 25° cool coast to inland neighborhoods throughout the weekend. good morning. still seeing a lot of brake lights in san jose northbound 101 with an injury crash at alum rock, vick heavy, 10 minute delays on north 101 if you want to consider highway 87 it is slow as well along this stretch before you get to 280, 26 miles an hour. another injury crash oakland eastbound 58 own the seminary on-ramp which is currently blocked now. 580 is flowing well, 67 miles per hour. if you want to get on to eastbound 580 you may want to consider keller. in richmond police activity on south 7th, closed between

virginia avenue and main avenue. 580 itself is fine. little bit of pockets of slowing westbound 80 through richmond as well. i also wanted to take you to abc 7's exclusive waze traffic map to show you westbound 37, a stalled big rig on the mayer island bridge, 34 miles an hour through the area, seems slow on jamison canyon at 20 miles per hour. you can get street level traffic see speeds with our waze app. bay bridge toll, metering lights on backed up towards the 880 overcrossing. normally terming lights are turned on by the caltrans office in oakland today they had to do it from the bay bridge because of a software problem. golden gate bridge traffic flowing, but check out the fog. berkeley high kids could have fixed that software problem, i'm sure. they are great with computers. trading underway on wall

of hitting major chinese cities of beijing and shanghai this is video of the launch conducted yesterday. the missile which is called hindi word for fire, is the country's most advanced missile so far. experts say it say defensive tool that could be used as a deterrent against pakistan and china. right now, officials, dignataries and survivors preparing for a solemn ceremony marking the 17th anniversary of the oklahoma city bombing. april 19th, 1995, a bomb destroyed most of the alfred p murrah federal building in oklahoma city, killing 168, injuring more than 500. we just lost the live feed you saw people getting ready for that ceremony. this morning the governor in oklahoma will join survivors from new york's september 11th attacks for a special tribute. embattled sheriff ross mirkarimi heads back to court

to fry to keep his job. >> amy hollyfield is live in -- to >> reporter: he's going to be fighting aggressive to try and keep his job over the next few days. he's going to try a couple different tactics. first today, ross mirkarimi will be asking a judge to remove the city attorney from this case. mirkarimi believes he has a conflict of interest. that one looks like it going to be a long shot. the judge said yesterday, it looks like it is going to be fine for the city attorney to be on the case they will argue that today if he loses, tomorrow he will be asking the judge to overturn his suspension. he was suspended without pay last month, after pleading guilty to a domestic violence-related charge. if that doesn't work, then mirkarimi has a hearing in front of the ethics commission that will start monday over whether he can remain the city's sheriff. a lot of developments to follow on this case over the next few days. we will be keeping you posted. our other top story is in santa clara. terry mcsweeney is there and
